The Municipality of Falconara Marittima is the DATA CONTROLLER  of personal data concerning you (Interested) and your family which can be communicated to the Municipality through paper forms or sent via web tools, at the time of any request or coming from other municipalities or other public bodies as required by the relevant legislation.

The DATA PROTECTION OFFICER (or DPO) is your point of contact for any question or problem related to the application of the Regulation.

WHY WE TREAT YOUR DATA (PURPOSE AND LEGAL BASIS)

We treat your data for the performance of institutional functions, for the fulfilment of legal obligations such as civil, fiscal, accounting, administrative and security management but also for the evaluation of the quality of the services provided, for the obligations of a pre-contractual, contractual, legal nature, for service communications, management of complaints and finally for the response to requests for information forwarded.

Your personal data, even if collected by a specific municipal sector, may also be used by the Data Controller for needs in other sectors, provided that the processing is always connected to the pursuit of the institutional purposes.

WHAT WE DO WITH YOUR DATA (Data categories and necessary requirement)

We usually only request and process “common” personal data and only in some cases “special” data; it will be the responsibility of the Municipality staff to provide you and your family with all the necessary information. Treating your personal data is mandatory and necessary in order to take advantage of the numerous services provided by the Municipality as they are closely linked to institutional functions; for other treatments, will be necessary to request your consent, as they relate to activities that do not fall within the institutional functions required by the regulations.

HOW WE TREAT YOUR DATA AND WITH WHAT  MEANS (Treatment modality)

We process your personal data at the municipal offices, in paper and digital format. We take all the technical and organizational measures necessary to avoid problems of unauthorized access, disclosure, modification or destruction. For some treatments we also use the cloud, but with data centers positioned exclusively in Italy. Only the authorized personnel can access to carry out the operations of treatment or maintenance of the systems.

automated decision making and profiling systems are not used.

WHERE AND TO WHO YOUR DATA GOES (Communication to third parties and categories of recipients)

Your data will never be disclosed and will not be disclosed without your consent except in the cases provided for by laws and regulations.

Your data may be subject to access according to Law 241/1990 and to publicity, transparency and information disclosure obligations on the part of public administrations according to Legislative Decree 33/2013. If necessary, may be entrusted to companies that carry out activities on behalf of the Owner, appointed External Managers and instructed to process the data in compliance with the regulations.

Your data will not be transferred either to Member States of the European Union, or to third countries not belonging to the European Union and with personal data protection regulations not aligned with European Regulation 679/16.

HOW LOGN WE KEEP YOUR DATA (data storage Period)

The national data storage regulations require that your personal data continue to be stored for as long as is necessary to achieve the above-mentioned purposes and for the times envisaged by the legislation in force.

Under some procedures we collect personal data directly from the interested party while in others it is necessary, in accordance with the discipline, to request information from other bodies or from public registers and / or databases.

YOUR RIGHTS

You can request directly to the Data Controller to see, correct, delete or limit the data we process and that concern you or your family. In some cases, you can also oppose or withdraw your consent to the processing; it also has the right to data portability and therefore in certain situations it may require a digital copy of the same or automatic transfer between public bodies.

HOW YOU CAN EXERCISE YOUR RIGHTS

If you have any doubts, if we store incorrect, incomplete data or if you think we have mishandled your personal data, please contact the Data Protection Officer (DPO) or send a request using the Request form. rights, downloadable from the Municipality’s website.

Our Data Protection Officer (DPO) will review your request and contact you to resolve the issue as soon as possible. Otherwise, you have the right to make a complaint with the Data Protection Authority.

UPDATES

The Disclosure is the instrument designed by the Regulation to apply the principle of transparency and to facilitate you (interested party) in the management of the information that we treat and concern you. As the treatment modalities, national or European regulations change, the information can be reviewed and integrated; in case of important changes, notice will be given on the institutional website.
